Understanding Building Classifications: Why It Matters for Your Project on the Northern Beaches

When planning a build, renovation, or development, one of the most important (and often overlooked) factors is your building classification.

At Fox & Ko, we guide Northern Beaches homeowners, developers, and investors through this process every day. Getting it right early can save time, reduce risk, and ensure your project complies with Australian building laws.

What Are Building Classifications?

Building classifications are defined under the National Construction Code (NCC). They group buildings based on how they are used, which then determines the rules for design, construction, and compliance.

Every building falls into a category from Class 1 to Class 10, with each class carrying specific requirements around safety, structure, and performance.

Understanding your classification is critical because it directly impacts:

  • Approval pathways
  • Construction standards
  • Compliance obligations
  • Project costs and timelines

The Most Common Building Classes on the Northern Beaches

Class 1a – Houses and Townhouses

This is the most common classification for residential clients.

Includes:

  • Freestanding homes
  • Duplexes
  • Townhouses and terraces

If you’re building or renovating in areas like Manly, Warriewood, or Newport, your project will typically fall under Class 1a.

Class 2 – Apartments and Multi-Unit Dwellings

A Class 2 building is defined as:

“A building containing two or more sole-occupancy units, where each unit is a separate dwelling.”

A sole-occupancy unit (SOU) is a part of a building used by one owner, tenant, or occupier to the exclusion of others. In simple terms, it’s a private, self-contained space within a larger building.

Important Distinction

Not all multi-dwelling developments are Class 2.

For example:

  • A townhouse is typically Class 1a, as each dwelling is considered a separate building

However:

  • If there is any shared space below (such as a basement carpark or common area), the classification changes

In this case, the building becomes Class 2, even if the dwellings appear similar to townhouses.

This distinction is often misunderstood and can significantly impact approvals and compliance.

Class 2 Buildings are common in Collaroy, Dee Why and Manly.

Class 10 – Non-Habitable Structures

These are secondary structures on your property, such as:

  • Garages
  • Carports
  • Sheds
  • Pools and retaining walls

While non-habitable, they still need to meet NCC compliance standards.

Why Classification Matters for Your Project

Building classification isn’t just a label; it defines the framework for your entire project.

1. Compliance and Regulations

Different building classes are subject to different rules. In NSW, stricter legislation applies to Class 2 buildings, increasing accountability across design and construction.

2. Design Requirements

Your classification determines key design elements, including:

  • Fire separation
  • Structural performance
  • Acoustic requirements
  • Accessibility standards

For example, a Class 1a duplex requires fire-rated separation walls, while Class 2 buildings require more complex compliance systems.

3. Approval Pathways

Incorrect classification can delay approvals or lead to costly redesigns.

Councils and certifiers rely on accurate classification when assessing:

  • Development Applications (DA)
  • Complying Development Certificates (CDC)
  • Construction Certificates

    4. Risk and Responsibility

On 1 July 2021, the NSW Government introduced the Design and Building Practitioners Act 2020 (DBP Act). The legislation created new obligations and mandatory compliance requirements to improve the quality of residential apartment construction across NSW.

    The DBP Act currently regulates:

    • Class 2 buildings
    • Certain Class 3 buildings (long-term or transient accommodation)
    • Class 9c buildings (residential care facilities)

Under the legislation, the following practitioners must be registered to carry out regulated work:

    • Design practitioners (architects and building designers)
    • Building practitioners (builders)
    • Professional engineers

These practitioners are required to provide compliance declarations confirming that building work and designs meet the requirements of the Building Code of Australia (BCA).

Importantly, not all builders are registered to work on Class 2 projects.

Before engaging a builder or contractor for an apartment or multi-residential development, it is essential to check the NSW Class 2 registration database to confirm they are appropriately registered.

Fox + Ko are proudly Class 2 registered, providing clients with confidence that our work meets NSW compliance requirements for regulated buildings.

The Challenge for Smaller Class 2 Projects

One of the biggest frustrations for clients is that smaller Class 2 developments — such as one or two-storey apartment buildings or terraced apartments — are regulated in the same way as large multi-storey apartment buildings.

This means even relatively small developments can trigger:

    • Extensive compliance documentation
    • Detailed regulated design packages
    • Additional consultant coordination
    • Longer approval timeframes
    • Increased construction and certification costs

While the legislation has improved accountability within the industry, it has also added significant complexity to smaller-scale projects across the Northern Beaches.

Understanding these requirements early is essential to avoid delays, unexpected costs, and compliance issues during construction.

    Common Mistakes We See

Across the Northern Beaches, common issues include:

    • Confusing Class 1a homes with Class 2 developments
    • Misclassifying dual occupancies with shared basements
    • Underestimating compliance requirements for secondary structures
    • Treating garages or studios as “simple add-ons”

These can lead to delays, compliance issues, and unexpected costs.
