Thinking about renovating or building a new home on the Northern Beaches?
Before you start, understanding the NSW planning approval process is essential.

Every property is unique. Zoning, overlays, and council controls all influence what you can and can’t build. Getting this right early helps you avoid delays, re-designs and unexpected costs.

At Fox + Ko, we guide our clients through this process every day, so here’s a straightforward breakdown to help you get started.

Northern Beaches Council Planning Controls Explained

The Northern Beaches Council was formed by merging Manly, Warringah, and Pittwater councils. While the council operates as one, the original planning controls still apply depending on your property location.

This means your project may be governed by different Local Environmental Plans (LEPs) and Development Control Plans (DCPs) based on whether your property sits in the former Manly, Warringah, or Pittwater area.

For example:

  • Manly areas often have tighter controls around heritage and streetscape
  • Warringah areas may focus more on building scale and setbacks
  • Pittwater areas commonly include environmental and coastal restrictions

Understanding these differences is critical when planning a renovation, extension, or new build on the Northern Beaches. It directly affects design, approval pathway, and timeline.

The Three Main Planning Approval Pathways in NSW

1. Exempt Development (No Approval Required)

Some minor building works can be completed without approval under Exempt Development.

Common examples include:

  • Decks, pergolas, and patios
  • Carports and garden sheds
  • Fences and privacy screens
  • Minor home renovations (both interior & exterior)

To qualify, your project must meet strict guidelines under the NSW Codes SEPP.

Why it matters: This is the fastest and most cost-effective pathway, but only if your design fully complies with the NSW Codes SEPP standards.

2. Complying Development Certificate (CDC)

A Complying Development Certificate (CDC) is a fast-tracked approval for straightforward residential projects.

This is a popular option across Sydney and the Northern Beaches for:

  • New homes (up to two storeys)
  • Home extensions and renovations to a 1 or 2 storey dwelling house (including any addition that results in a 2 storey dwelling house)
  • Granny flats (secondary dwellings)
  • Swimming pools

Key benefits:

  • Faster approvals (typically 30–45 days)
  • Lower costs than a Development Application
  • Approved by a Principle Certifier (PCA) – can be either private certifier or council

To be approved, your design must meet all planning controls specified in the NSW Codes SEPP and the Building Code of Australia (BCA).

As a minimum you will need:

  • Building Design Plans
  • A detailed level and boundary identification survey (prepared by registered surveyor)
  • Structural Engineer plans & compliance documentation
  • Building Sustainability Index (BASIX) Certificate
  • Specifications for external finishes
  • Estimated development cost

Depending on the nature of your project / property location you may also require:

  • Hydraulic Engineer (Stormwater Management) plans & compliance documentation
  • Bushfire Consultant Report (BAL Assessment)

Neighbour notification is part of this process however they can not make submissions or object to the development.

3. Development Application (DA)

If your project doesn’t meet Exempt or CDC requirements, you’ll need to lodge a Development Application (DA) with council.

This is common for more complex builds or properties with constraints across the Northern Beaches Council area.

A DA requires at a minimum:

  • Building Design Plans including Demolition Plans, Proposed Floor Plans, Elevations, Sections, Site Analysis Plan, Shadow Diagrams, Waste Management Site Plans, Excavation and /or fill Plan
  • A detailed level and boundary identification survey (prepared by registered surveyor)
  • Structural Engineer plans & compliance documentation
  • Hydraulic Engineer plans (Stormwater Management) & compliance documentation
  • Building Sustainability Index (BASIX) Report/Certificate
  • Specifications for external finishes
  • Cost summary report form
  • Statement of Environmental Effects Report (SEE)
  • Waste Management Plan (WMP)
  • Landscape Plan (prepared by suitably qualified professional)

Depending on the nature of your project / property location you may also require:

  • Arborist Report (Arboricultural Impact Statement)
  • Aboriginal Heritage Assessment Report
  • Acid Sulfate Soil Report
  • Biodiversity Development Assessment (DBAR) or (Flora & Flora Assessment FFA)
  • Bushfire Report (BAL Assessment)
  • Coastal Risk Management Report / Coastal Risk Assessment Report
  • Estuarine Risk Management Report
  • Flood Risk Assessment (FIRA) / Overland Flow Study Report
  • Geotechnical Engineer Report
  • Statement of Heritage Impact
  • Water Management Plan / Waterways Impact Statement

At Fox + Ko, we specialise in Northern Beaches planning approvals, zoning assessments, and residential design documentation. Our team understands the Local Environmental Plans (LEPs), Development Control Plans (DCPs), and council requirements that apply across the Northern Beaches region.

What to expect:

A DA takes longer and costs significantly more than a CDC however allows for more flexibility in design.

What You Need Before You Start the Planning Process

To determine the right approval pathway, you’ll need key property information:

  • 10.7 Planning Certificate – zoning and restrictions
  • Certificate of Title – easements and legal boundaries
  • Survey Plan – levels, features, and site conditions

You can also review the relevant zoning & planning controls for your particular property on either the NSW Planning Portal ‘Spatial Viewer’ or via Northern Beaches Council mapping tool.

Site Constraints to Be Aware of on Northern Beaches

Certain properties across Sydney’s Northern Beaches may have additional restrictions which will impact the planning pathway available.

These include:

  • Acid sulfate soil classification
  • Coastal hazard, coastal zones or environmental zones
  • Bushfire-prone land
  • Flood-affected sites
  • Heritage-listed homes or conservation areas
  • Landslip or geotechnically unstable lands
  • Waterways & riparian lands
  • Wildlife corridors or threatened & high conservation habitats

If your property is affected, a Development Application is often required.
